In order to determine the future use of Mount Haven Resort, the Zoning Officer sent the following questions to Har Haven LLC. (owner of the Mount Haven property).  The following are the questions that were sent.

Dear Mr. Birnhack:

I am writing to you as you are listed as the owner of record for the property formerly known as Mount Haven Resort in Dingman Township, Pike County, Pennsylvania.

The Dingman Township Zoning Ordinance requires that a new Certificate of Use be obtained after a commercial structure or use has been transferred to a new party should there be any deviance between the new use and the previous use. The procedures for issuing the new certificate depend upon the degree of deviance and whether the new use conforms with the general requirements of the zoning ordinance and the specific requirements of the zoning district in which the property is located.

I have received two submissions concerning the property. In both cases, the information was too general and not specific enough to allow me to proceed. In order to facilitate my review, I have taken the liberty of preparing a list of questions that will allow me to better determine the exact nature in which you intend to use the facility.

Within the next 30 days, please submit to me the answers to the enclosed questions. Consult with SCHI as necessary.

Mount Haven Questions

 

Restaurant 

  1. Will the restaurant be open to the general public
  1. Will the restaurant be open to SCHI guests only?
  1. If the restaurant is open to the public, will it be open daily? Weekends only? Seasonally (when)?
  1. Will the restaurant’s catering be on-site only or include off-site catering too?
  1. What kind of cuisine will be offered by the restaurant? (This may be necessary to determine the suitability of the sewage system.)
  1. How many guests will the restaurant serve at one sitting (maximum)?
  1. How many meals will be served per day (maximum)?
  1. Which meals will be served (breakfast, lunch, dinner, etc.)?
  1. When will the restaurant reopen and be available to the public and/or guests?

Pavilion

  1. How will the pavilion be used by patrons of the hotel/motel?  What activities will take place there?
  1. How will the grounds around the pavilion be used by patrons of the hotel/motel?
  1. If used for catering/banquets, what is the maximum seating inside the pavilion?
  1. Are there going to be food preparation facilities in the pavilion?  If yes, describe.

Hotel/Motel Rooms

  1. Will the hotel/motel rooms be available to the traveling public?
  1. If yes, will there be any limitations to the availability (e.g. only open certain months, certain number of rooms)?   If yes, describe.
  1. Will there be any changes made to the rooms (e.g. adding cooking facilities, expanding the rooms)?
  1. What is the expected length of stay of the motel guests?
  1. Will there be limits to the length of time that guests may occupy the motel rooms (number of continuous days)?
  1. Will guests be able to use the motel as their permanent residence?
  1. Will there be a limit on the number of people housed in each room? If so, what would be the limit?
  1. Has a hotel tax collection license been obtained from Pike County?  If not, please explain.
  1. When will the hotel/motel be reopened and the rooms be available to guests?

Cabins

  1. Will the cabins be available for use by the traveling public?
  1. If yes, will there be any limitations to the availability of the cabins (e.g. only open during certain months)?
  1. Will there be any changes made to the cabins (e.g. adding cooking facilities, adding additional beds, expanding the cabin’s size etc.)?
  1. What is the expected length of stay of the motel guests?
  1. Will there be limits on the length of time a patron may occupy the cabin (number of continuous days)?
  1. Will guests be able to use the cabin as their permanent residence?
  1. Will there be a limit on the number of people housed in each cabin? If so, what limit?
  1. When will the cabins be reopened and the cabins be available to guests?

Mansion

  1. Will guests reside in the Mansion?
  1. If yes, will the guest rooms be available to the general public?
  1. If yes, will there be a time limit on the number of days that a guest may occupy the Mansion?
  1. Will guests be able to use the Mansion as their permanent residence?
  1. Will the Mansion be used for catered events?
  1. If yes, what will be the maximum seating?
  1. If yes, will the Mansion catering be available to the general public?

Retail Space

  1. Will the retail space be oriented to the resort (e.g. shops selling souvenirs, suntan lotion etc.) or shops selling general merchandise?
  1. Will the retail space target non-guests and the general public as patrons?
  1. Will the retail space be leased to businesses that provide services (e.g. barbershop, beauty salon etc.)?

SCHI

  1. How much of the year will SCHI utilize the property?
  1. If known, what weeks or months will the use occur?
  1. Will any of the facilities be available to the traveling public when SCHI students are present (e.g restaurant, motel rooms, catering, etc.)?
  1. Will the SCHI students engage in activities other than that normally performed by resort guests (e.g. education, physical therapy, medical procedures, etc.)?
  1. Will parents/guardians be present when the SCHI students use the property?
  1. If yes, will they be allowed to bring other family members or friends with them?
  1. How many SCHI students will be on the property at one time (maximum number)?
  1. How many SCHI staff will accompany the children (maximum number)?

Other

  1. Does the property have a valid Pennsylvania DEP drinking water system permit?  If not, please explain.
  1. The SCHI use is often referred to as a camp. Has Pennsylvania issued a youth camp permit for the use? If not, please explain.
  1. Does the restaurant (and Mansion and pavilion, as applicable) have the appropriate Pennsylvania food service licenses?  If not, please explain.
  1. Does the resort require a Pennsylvania public bathing facility approval, and if yes, has it been obtained?  If no, please explain.
  1. If there adequate parking for all the uses previously mentioned?
  1. Will there be any uses of the property not previously mentioned in these questions?  If yes, please explain in detail.
  1. Will guests engage in activities or be provided services other than that normally performed by resort guests (e.g. education, physical therapy, medical procedures, etc.)
  1. Is there adequate parking for multiple events occurring simultaneously on the property (e.g. maximum motel occupancy and a maximum seating banquet)?
  1. Will there be any full-time residency on the property?  If yes, how many people and where will they be housed?
  1. Do all SCHI staff that will be working on the property have a Pennsylvania Human Services background check and approval?  If not, please explain.
  1. Will there be any need for specialized emergency or medical services (beyond that normally provided by an ambulance or ALS ambulance)?  If yes, will SCHI be relying on the public services or providing their own services? If you will be providing your own services do the individuals or entities providing such services have the necessary Pennsylvania state approvals or certifications? If not, please explain.
  1. If SCHI provides its own medical transport, does it have the necessary Pennsylvania credentials?
  1. Will SCHI provide physical therapy or other such services to their students?  If yes, please explain.
