RESOLUTION NO. __________

A Resolution Authorizing Participation in the Municipal Risk Management

Workers’ Compensation Pooled Trust

Dingman Township, Pike County ordains as follows:

SECTION 1.   The proper officers are hereby authorized to execute and deliver the following documents: 

A).       The Municipal Risk Management Worker’s Compensation Pooled Trust Agreement (hereafter the Agreement)

B).       The Participant’s Application – which documents are attached hereto and made part Hereof and which may be inspected by any interested citizen at the office of the authority secretary.

SECTION 2.   The duration of the term of the Agreement is four years from the date of admission to the Trust as Participant.

SECTION 3.   The purpose and objectives of the Agrement are set forth in Article V of the Agreement.

SECTION 4.   The powers and scope of the delegate are set forth in Article II, Article V, Article VI, Article VIII and Article IX of the Agreement. 

SECTION 5.   The funds for meeting the obligations of the entity under the Agreement shall be appropriated from the general funds.

SECTION 6.   The organizational structure necessary to implement the Agreement consists of the Trust, Trustees, Service Agents and Fiscal Agents created by the Agreement.

SECTION 7.   Property acquired for purposes of the Trust shall be acquired, managed and disposed of under the terms of the attached Trust Agreement.

SECTION 8.   The Trust shall be empowered to enter into contracts for policies of group insurance and employee benefits, including social security for its employees.

DINGMAN TOWNSHIP, PIKE COUNTY, PA

 A POLICY FOR ESTABLISHING A FUEL REIMBURSEMENT FOR THE VOLUNTEERS WHO SERVE THE DESIGNATED FIRE DEPARTMENTS AND EMERGENCY MEDICAL SERVICES OPERATING IN DINGMAN TOWNSHIP

 Article 1.  Short title

This Policy may be cited as the Firefighters Fuel Reimbursement Policy for the volunteers who serve the designated fire departments and emergency medical services operating in Dingman Township.

Section 2.  Authority and Purpose

1.            This Ordinance is authorized by 53 P.S. § 66553, Section 1553 and Section 1528 of the Second Class Township Code which provides that the Township shall be responsible for ensuring that fire and emergency medical services are provided within the Township, including the appropriate financial and administrative assistance for these services.

2.            The purpose of this Ordinance is to create an incentive for current fire and EMS volunteers to remain active as well as increase recruitment of new volunteers.

Section 3.  Definitions

The following words and phrases, when used in this Ordinance, shall have the meaning given to them in this section, unless the context clearly indicates otherwise:

  "Active volunteer . " A volunteer for a designated volunteer fire company or nonprofit emergency medical services agency who has complied with the requirements of the fire/EMS company  and who is certified under this Policy. 

   "Designated Emergency medical services agency."  A state certified emergency medical services entity having an Agreement with Dingman Township to provide said services within all or part of the Township by operating any of the following:

     
(1) An ambulance.
     (2) An advanced life support squad vehicle.
     (3) A basic life support squad vehicle.
     (4) A quick response service.

     (5) A special operations EMS service. This paragraph includes, but is not limited to:
         (i) a tactical EMS service;
         (ii) a wilderness EMS service;
         (iii) a mass-gathering EMS service; and
         (iv) an urban search and rescue EMS service.
     (6) A vehicle or service which provides emergency medical services outside of a health care
          facility, as prescribed by the Department of Health by regulation.


   "Designated Volunteer fire company." A nonprofit chartered corporation, association or organization located in and certified by this Commonwealth that has an Agreement with Dingman Township to provide fire protection and rescue services in all or part of Dingman Township.

   “Township.” Dingman Township, Pike County, Pennsylvania.


   "Volunteer." An unpaid member of a designated volunteer fire company or emergency medical services agency.

Section 4.  Fuel Reimbursement

A.          A Township volunteer who serves a fire department or emergency medical service operating in Dingman Township shall receive reimbursement at the rate of 50 cents per mile up to a maximum of $250.00 per calendar year and who meets the requirements as outlined in Section 6 hereof.

Section 5.  Eligibility

A.                An active volunteer who satisfies all of the following criteria may claim a $250.00 reimbursement:

a.       The volunteer is an Active volunteer in the fire department or emergency medical services agency operating in Dingman Township; and

b.      The volunteer is certified as defined in this Ordinance.

Section 6.  Active Volunteer

A.          Active volunteers shall be determined based on the volunteer’s use of his or her private vehicle or vehicles to travel to and from calls or other company related events at a minimum of 500 miles per year.

B.                 Certification

a.       The President and Fire Chief or EMS Captain as appropriate, of each company shall sign and submit an application for reimbursement with a list of certified eligible active volunteers to the Township Secretary by March 1st of each year which certification shall be for the preceding year.

C.                 Payment

 The first year that the fire departments or emergency medical services agencies shall  

             provide a certified list shall be March 1, 2019.  Payment of the benefit to each volunteer

 as defined by this Policy shall occur on or after April 1st of each year.

Section 7.  Rejection and Appeal

A.          A claim by an active volunteer who has been informed by his Department that he/she does not satisfy all the criteria established under this chapter shall be reviewed by the Township Supervisors for final determination.

a.         Said claim shall be in writing and submitted to the Township Secretary within ten (10) days of being notified that the volunteer does not meet the criteria.

B.           A claim rejected by the Board of Supervisors may be appealed within thirty (30) days of denial to the Court of Common Pleas of Pike County.

Section 8.  Penalties

A.                Any person who knowingly makes or conspires to make a false service record report under this chapter commits a misdemeanor of the first degree punishable by a fine of $2,500.

B.                 Any person who knowingly makes or conspires to provide false information that is used to compile a service record report under this chapter commits a misdemeanor of the first degree punishable by a fine of $2,500.

Section 9. Fair Labor Standards Act

Nothing in this Ordinance shall be construed as compensation in violation of the Fair Standards and Labor Act so as to disqualify a volunteer of their status as a volunteer.

Section 10.  Severability

Each section and subsection of this Policy shall be deemed to be severable and not affected by any determination that any other provision of this Policy is unenforceable.  If any sentence, clause, section, or part of this Policy is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this Policy.  It is hereby declared as the intent of the Supervisors that this Policy would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included herein
