Ordinance Prohibiting the Abandonment of Vehicles

(Junk Cars)

ORDINANCE 06 - 93

ORDINANCE PROHIBITING THE ABANDONMENT OF VEHICLES

1.         ABANDONMENT OF VEHICLES PROHIBITED

            No person shall abandon any vehicle within the Township, or shall leave any vehicle at any place within the Township for such time and under such circumstances as to cause such vehicle reasonably to appear to have been abandoned, whether such vehicle is completely intact, partially dismantled, inoperative, wrecked, or junked.  For purposes of this section a vehicle shall be considered abandoned if it has not had a valid inspection sticker for a period of more than six (6) months.

2.         LEAVING INOPERATIVE VEHICLES ON HIGHWAYS PROHIBITED

            No person shall leave any inoperative, partially dismantled, wrecked, or junked vehicle on any Township road or highway unless that vehicle was disabled or involved in an accident and arrangements have been made to tow it from the scene.

3.         DISPOSITION OF INOPERATIVE VEHICLES

                        A.  No person in charge or control of any property in the Township, whether as owner, tenant, occupant, or otherwise, shall allow any inoperative, partially dismantled, wrecked, junked, or discarded vehicle to remain on such property.  Upon fifteen (15) days written notice from the Township, the vehicle shall be removed.

                        B.  This prohibition shall not apply to a vehicle in an enclosed building, on the premises of a business when necessary to the lawful operation of the business, vehicles actually used in farming on an operating farm or located in a junk yard licensed by the Township.

4.         IMPOUNDMENT

            Any member of the Board of Supervisors is vested with the authority to enforce the terms and conditions of this Ordinance, and is hereby authorized to have removed from any roadway or roadway right of way in the Township any vehicle that he or she has probable cause to believe is in violation of this Ordinance, or lost, stolen, or unclaimed.  Such vehicle shall be impounded until lawfully claimed or disposed of in accordance with the laws of the Commonwealth of Pennsylvania.  The owner of the vehicle shall be responsible for all costs incurred by reason of the impoundment or storage.

5.         PENALTY

            Any person who violates any provision of this Ordinance or who resists or interferes with any officers, agents, or employees of the Township who, in accordance with the provisions of this Ordinance, are in the performance of their duty, shall, upon conviction thereof in a summary proceeding, be sentenced to pay a fine of not more than six hundred dollars ($600), or shall be imprisoned for a period of not more than thirty (30) days, or both.  Each day’s continuance of each violation shall constitute a separate offense. All fines collected for the violation of this Ordinance shall be paid to Dingman Township.

6.         ENACTMENT

            The enactment of this Ordinance shall serve as a repeal of any other ordinance inconsistent herewith.

            This Ordinance shall be effective five (5) days from the date of adoption.

                        Ordained and enacted this 23rd day of November 1993.
