AN ORDINANCE TO
PROTECT THE
HEALTH AND
SAFETY OF
CONSTRUCTION
PERSONNEL AND
THE GENERAL
PUBLIC BY
REQUIRING THAT
SITES ARE
PROVIDED WITH
SATISFACTORY
SANITARY
FACILITIES.
NOW, THEREFORE,
BE IT ORDAINED
AND ENACTED by
The Board of
Supervisors of
Dingman
Township, Pike
County,
Pennsylvania,
and is hereby
ordained and
enacted by their
authority.
Section
1: Short title
This ordinance
shall be known
and may be cited
as the “Dingman
Township
Construction
Sanitation
Ordinance.”
Section
2: Purpose
It is the
intention of
this Ordinance
to protect
construction
workers and the
public, at
large, by
ensuring all
construction
sites have
adequate toilet
facilities
available to the
construction
workers.
Section
3: Definitions
For
the purpose of
this Ordinance,
the following
words and
phrases shall
have the meaning
given herein:
Construction
Site-
all sites with
construction
activity
requiring a
permit under the
Dingman Township
Building Code.
Construction
Worker-
any and all
people involved
in the
construction of
a house or other
structure
including but
not limited to
carpenters,
electricians,
excavators,
inspectors,
masons,
painters,
plumbers, and
roofers.
Portable
Chemical Toilet-
a portable
toilet facility
permittable
under
the Pennsylvania
Sewage
Facilities Act
regulations and
in which the
waste is held in
a chemical
solution until
such time as it
is disposed of
in a facility
licensed by the
Commonwealth of
Pennsylvania for
such disposal.
Section
4: Applicability
A.
Every
construction
site for which a
building permit
has been issued
shall have at
minimum one
portable
chemical toilet,
located in an
area convenient
to the
construction
workers working
at the site.
B.
The portable
chemical
toilet(s) shall
be kept in a
sanitary
condition and
shall have the
waste removed in
a timely manner.
C.
The portable
chemical toilet
must be on site
and available
for use prior to
the start of
construction on
the site and
must be removed
prior to the
issuance of the
Certificate of
Occupancy and
Use.
D.
The portable
chemical toilet
must be readily
available for
use by
construction
workers at all
times when work
is taking place
on the lot.
Section 5:
Exceptions
A.
A portable
chemical toilet
will not be
required when
the resident of
an existing
residential
structure that
is serviced by a
functional and
lawful Sewage
Disposal System
performs
construction
work on the
property on
which the
residence is
sited.
B.
The Dingman
Township
Building
Inspector may
issue a waiver
of the need for
a portable
chemical toilet
if the property
owner so
demonstrates to
the satisfaction
of building
inspector that
the construction
site may be
adequately
served by
alternative
toilet options.
Such options may
include, but are
not limited to,
a portable
chemical toilet
on a nearby
property,
permanent toilet
facilities in a
residence or
commercial
building for
which permission
of use has been
granted by the
property owner.
C.
The Building
Officer may
rescind a waiver
should he
determine that
the alternative
facility is not
satisfying the
intent of this
ordinance.
Section 6:
Permit Required
A
permit shall be
obtained from
the Township
Sewage
Enforcement
Officer prior to
placing a
portable
chemical toilet
on a
construction
site.
Section 7:
Violations
Any person, firm
or corporation
violating any of
the provisions
of this code
shall upon
conviction be
sentenced to pay
a fine of not
more than One
Thousand
($1,000.00)
dollars. Each
day a violation
exists
constitutes a
separate
offense. In
default of
payment of the
fine, such
person, members
of firms, shall
be liable to
imprisonment for
not more than
sixty (60) days.
Section 8:
Severability
The provisions
of this
Ordinance shall
be severable,
and if any of
its provisions
shall be held to
be
unconstitutional,
illegal, or
invalid, such
unconstitutionality,
illegality or
invalidity shall
not affect the
validity of any
remaining
provisions of
this ordinance.
