Maintenance of Trees Along Public Roads

 Ordinance # 17-2002 

AN ORDINANCE OF DINGMAN TOWNSHIP REGULATING THE PLANTING, REMOVING AND MAINTAINING OF CERTAIN TREES ESTABLISHING RESPONSIBILITY FOR REMOVAL AND TRIMMING AND PRESCRIBING PENALTIES FOR VIOLATION. 

The Supervisors of Dingman Township, at a regularly or specially advertised meeting, do hereby ordain and enact the following:

 1.                  Limbs.  Every owner of real property in the Township shall be required to keep limbs and branches of all trees upon such real property or along the roads, streets, sidewalks, curbs or alleys abutting such property trimmed so that no part thereof shall have a clearance of less than 8 feet above any public sidewalk or 14 feet above the surface of any public roadway, street or alley. 

2.                  Removal.  The Board of Supervisors may require owners of property to cut and remove trees located on the property if the condition of the trees, through disease or otherwise, unreasonably affects or interferes with the health, safety or welfare of the public or the right of the public to the unobstructed use of public roads or

3.                  Notice.   If within thirty days after the date of notice by certified mail, return receipt requested, to remove the trees, the property owner has not complied with that order, the commission or the Board of Supervisors may enter the premises and remove the trees.

 4.                  Cost.   The cost of cutting and removal of trees by the township shall be charged to the property owner.  The charge shall be a lien against the real estate of the property owner and shall be collected in the same manner as other municipal liens.

 5.                  Penalties.  Any owner of property who violates this Ordinance shall be subject to a penalty of up to $ 600.00 per violation.

 6.                  Severability.  The provisions of this Ordinance shall be severable and, if any of the provisions hereof shall be held invalid or unenforceable, the remaining provisions of this Ordinance shall remain in effect. 

7.                  Repealer.  All ordinances or parts of ordinances conflicting with any of the provisions of this Ordinance are hereby repealed in so far as same affects this Ordinance.

 

8.                  Effective date.  This Ordinance shall become effective immediately.
