AN ORDINANCE
SETTING
WEIGHT
LIMITS FOR
TRAVEL UPON
TOWNSHIP
ROADS WITHIN
DINGMAN
TOWNSHIP,
ESTABLISHING
PERMITS FOR
OVERWEIGHT
VEHICLES AND
SETTING
PENALTIES
FOR
VIOLATIONS
OF THESE
REGULATIONS.
The Board of
Supervisors
of Dingman
Township,
Pike County,
Pennsylvania
herby enact
and ordain
the
following
ordinance:
1. The
weight limit
for all
vehicles
traveling
upon
township
roads,
within
Dingman
Township as
described
hereafter,
shall be ten
(10) tons,
unless such
vehicle
shall have
first
obtained a
permit from
the township
for local
delivery.
2. The
Supervisors
may, from
time to
time, post
any township
roads with a
ten (10) ton
limit when
they have
determined
that such
weight limit
is
necessary,
because of
the season
or the
condition of
the road, to
protect the
road from
substantial
damage.
3.
Applications
for permits
for
temporary
travel of
overweight
vehicles may
be made to
the Township
Supervisors.
The
applications
shall set
forth:
a.
the
reason
for
local
travel;
b.
the
proposed
route of
travel;
c.
the
estimated
weight
of the
vehicle
and
load;
d.
the date
or dates
of such
travel.
4. The
Township,
after
consultation
with the
Township
Engineer may
require a
bond or cash
security to
be posted
which may
offset the
cost of any
repairs
necessary to
repair
damage
caused by
the travel
of said
overweight
vehicles.
5. The
Township may
retain the
bond or
security for
a period of
no more than
ninety (90)
days after
the last use
of the road.
6. No
permit shall
be for a
period of
time longer
than thirty
(30) days.
7. The
supervisors
retain the
right to
deny a
permit when,
in their
opinion, the
risk of
substantial
or permanent
damage to
township
roads,
bridges or
other
improvements
out weighs
the need for
a permit.
8.
Violations
and
penalties.
Any person
who shall be
convicted of
violating or
failing to
comply with
the
provisions
of this
chapter
before any
District
Magistrate
shall be
subject to a
fine of not
more than
Three
Hundred
($300.00)
dollars,
together
with costs
of
prosecution,
and in
default of
payment of
such fine
and costs,
to
imprisonment
in the
county jail
for a term
not to
exceed
thirty (30)
days. The
continuation
of such
violation
for each
successive
day shall
constitute a
separate
offense, and
the person
or persons
allowing or
permitting
the
continuation
of the
violation
may be
punished as
provided
above for
each
separate
offense.
