An Ordinance of the
Township of Dingman,
Pike County,
Pennsylvania,
prohibiting the
dumping, shoveling,
pushing, or
placement of any
snow, ice, slush, or
any combination
thereof, into the
main cartway of
streets or avenues
of the Township and
prescribing
penalties for
violation.
Be it enacted and
ordained by the
Board of Supervisors
of Dingman Township,
Pike County,
Pennsylvania as
follows:
Section 1 Title
This Ordinance may
be known and may be
cited as the
“Dingman Township
Snow Removal
Ordinance.”
Section 2 Purpose
This Ordinance is
adopted for the
purposes of
preventing the
creation of any
obstacles to
vehicular traffic
and otherwise
providing for the
safety of persons
traveling in
vehicles during and
following periods of
snowfall in the
Township.
Section 3
Application to
Public Highways
This Ordinance shall
apply to all public
highways within the
Township of Dingman,
regardless of
authority for
maintenance.
Section 4
Declarations of
Policy
Any owner, occupant,
tenant or other
person who removes
snow, ice, slush, or
any combination
thereof, from
sidewalks, driveways
or any other place
within the Township
of Dingman shall not
place the same on
any public street or
thoroughfare after
such time as the
street or
thoroughfare has
been plowed and
cleared for the
purpose of allowing
free and safe
passage of vehicular
traffic thereon.
Section 5 Penalties and Remedies
Any person, partnership or corporation who or which shall violate or permit to be violated the provisions of this ordinance shall, upon being found guilty therefore in a proceeding brought by the Township before a District Justice, pay a fine of not more than one thousand ($1000.00) dollars plus all court costs, including reasonable attorney’s fees incurred by a municipality as a result thereof. No fine shall commence or be imposed, levied or be payable until the date of the determination of the violation by a district justice. Each day that a violation is continued shall constitute a separate offense, unless the district justice that determines that a violation has occurred further shall determine that there is a good faith basis for the defendant to have believed that there was no such violation, in which event there shall be deemed to have been only one such violation until the fifth day following the date of the determination by such district justice and thereafter every day shall constitute a separate offense. All fines and cost collected for the violation of this ordinance shall be paid over to the Township Supervisors.
In case of any violation of this ordinance the Township Supervisors or, with the approval of the Township Supervisors, an officer of the Township, in addition to other remedies, may institute in the name of the Township any appropriate action or proceeding to prevent, restrain, correct, or abate such violation.
Section 6
Severability
If any portion of
this Ordinance shall
be declared
unconstitutional the
other portions shall
remain valid.
Section 7 Enactment
This Ordinance shall
take effect five (5)
days following
enactment
