AN ORDINANCE
REGULATING
OUTDOOR FIRES
IN DINGMAN
TOWNSHIP
The
Supervisors of
Dingman
Township, at a
regularly or
specially
advertised
meeting, do
hereby ordain
and enact the
following:
1.
It is unlawful
for any person
to kindle or
maintain any
outdoor fire or
to authorize
others to do so
on any public or
private property
within Dingman
Township during
the time that
the Board of
Supervisors has
declared a
burning ban.
2.
The Supervisors
may, after
consultation
with fire
department and
other officials,
from time to
time declare a
burning ban when
the Supervisors
have determined
that the
physical
condition of the
forests and
private lands
are such that
any outdoor
burning would be
unsafe.
3.
The burning ban
set forth above
shall not apply
to a small,
well-controlled
fire in a
barbecue or
similar device
manufactured and
used for
cooking,
provided that
said fire is
attended by a
responsible
person until
extinguished.
4.
Any burning ban
enacted pursuant
to this
ordinance shall
become effective
upon
announcement of
same at an
advertised
township
supervisors
meeting or upon
advertisement of
same in a
newspaper of
general
circulation in
the community.

Any person,
partnership
or
corporation
who or which
shall
violate or
permit to be
violated the
provisions of
this ordinance
shall, upon
being found
liable therefore
in a civil
enforcement
proceeding
brought by the
Township, pay a
judgment of not
more than five
hundred ($ 500)
dollars plus all
court costs,
including
reasonable
attorneys
incurred by a
municipality as
a result thereof
and any costs
incurred by any
fire company
incurred in
extinguishing
any fire set in
violation of
this ordinance.
No judgment
shall commence
or be imposed,
levied or be
payable until
the date of the
determination of
the violation by
a district
justice. If the
defendant
neither pays nor
timely appeals
the judgment,
the municipality
may enforce the
judgment in the
manner provided
in the rules of
civil
procedure. Each
day that a
violation is
continued shall
constitute a
separate
offense. All
judgments and
cost collected
for the
violation of
this ordinance
shall be paid
over to the
Township
Supervisors.
The Supervisors
hereby designate
the code
enforcement
officer of the
Township and the
Chief or
Assistant Chiefs
of any fire
department
authorized to
operate in the
Township to
enforce the
terms of this
ordinance in
addition to the
Supervisors
themselves.
