An Ordinance
providing for
minimum standards
for Roads, Streets
and Highways to be
offered or accepted
for dedication to
Dingman Township,
Pike County,
Pennsylvania.
AND NOW, this
_____ day of
_______, 1977, it is
hereby enacted and
ordained by action
of Dingman Township
Board of Supervisors
at a regularly
scheduled public
meeting, as follows:
Purpose: The
purpose of this
ordinance is to set
forth minimum
standards for road
construction and for
reconstruction for
any road, highway,
street or other
thorofare
[sic]
which may be
presented to the
Township for
dedication as a
public road or
sought for
dedication as a
public road by the
Township.
A. Roads
Dedicated to the
Public:
1. All roads,
streets,
highways or
other
thoroughfares to
be considered
for dedication
as a public road
shall meet the
minimum
standards set
forth under
Article VII of
the subdivision
ordinance for
collective
street standards
(as a minimum)
in addition to
the minimum
requirements of
this subsection
along with any
other applicable
road standards.
2. Streets
shall have a
minimum
travelway width
of 24 feet.
Streets without
concrete curbing
shall have a
minimum cartway
of 36 feet.
3. The full
width cartway
shall be
constructed with
a minimum base
of 8" No. 2A
subbase, per
PennDOT
publication 408,
over
non-yielding
compacted
subgrade. The
subgrade shall
be proof rolled
and inspected by
the Township
Engineer prior
to placement of
any subbase
material.
4. A bituminous
concrete binder
course, meeting
the
specifications
of PennDOT
Publication 408
ID-2 shall be
placed at a
minimum
compacted depth
of 2-1/2"
5. A bituminous
concrete wearing
course, meeting
the
specifications
of PennDOT
Publication 408
ID-2 shall be
placed at a
minimum
compacted depth
of 1-1/2"
6. Shoulders
shall be
constructed of
PennDOT
Publication 408
No. 2A subbase,
8"in depth.
7. Pavement
cross-slopes on
tangent typical
sections shall
be a minimum of
1.5% and a
maximum 2.5%.
Pavement cross
slopes or super
elevated typical
sections shall
be a minimum of
2% and a maximum
of 8%, designed
in accordance
with PADOT DM-2.
8. A stormwater
management
report shall be
prepared by a
licensed
professional
engineer for all
stormwater
facilities such
as side swales,
storm drainage
systems, etc.
9. The entire
right-of-way of
the proposed
road shall be
fully monumented
including all
horizontal
changes in
direction such
as points of
curvature and
tangency along
both sides of
the ROW.
10. The
applicant shall
be fully
responsible for
all professional
fees incurred by
the Township
regarding the
construction and
offer of
dedication of
the roadway.
These fees may
include periodic
project
observation by
the Township
Engineer,
Township
Solicitor
services,
independent
testing of the
roadway's
material, etc.
The Township
shall estimate
the cost of
these services
prior to the
start of
construction.
The applicant
shall either
include the
estimated cost
of these
services prior
to the start of
construction.
The applicant
shall either
include the
estimated cost
of the separate
line item, if
one is posted,
or guarantee the
payment of these
fees by posting
a separate bond,
in cash or in
other form
acceptable to
the Township.
B. The Offer of
Dedication Shall
include:
1. A recordable
As-Built drawing
of the roadway
prepared, signed
and sealed by a
surveyor
licensed in the
Commonwealth of
Pennsylvania
delineating, at
minimum, the
Right-of-Way,
limits of the
constructed
road, metes and
bounds
description of
the
Right-of-Way,
location of the
monumentation,
road profiles,
roadway cross
sections, at an
interval
acceptable to
the township
engineer,
property that
intersect the
Right-of-Way,
names of
adjoining
property owners
and the location
of
infrastructure
such as but not
limited to
culverts and
utilities.
2. A deed to
the parcel
acceptable to
the Township
Solicitor and in
a recordable
form.
3. A letter of
certification
from a PA
licensed
professional
engineer,
retained by the
applicant,
stating that the
road was
constructed in
substantial
compliance with
the design plans
and
specifications.
4. After
completion of
the road, the
applicant shall
post a
maintenance bond
for a period of
eighteen (18)
months after
acceptance by
the Township in
the amount of
fifteen (15%)
percent of the
cost of
construction.
14. The Township
shall have no
responsibility of
any kind with
respect to any
highway or drainage
facility in
connection
there-with, not
withstanding the use
of the same by the
public unless the
highway or drainage
facilities are
accepted by
resolution of the
Supervisors.
C. Severability
The provisions of
this Ordinance shall
be severable and, if
any of the
provisions hereof
shall be held to be
invalid or
unenforceable, the
remaining provisions
of this Ordinance
shall remain in
effect.
D. Repealer
All ordinances or
parts of ordinances
conflicting with any
of the provisions of
this Ordinance are
hereby repealed in
so far as same
affects this
Ordinance.
